This Privacy Policy applies to your use of DataCue's website located at (the "Website", the "Site"), DataCue's personalization service and any or all other Services or Applications on all platforms (the "Service", the "Services") unless explicitly stated otherwise.

DataCue is a Singapore private limited company subject to the laws of Singapore. This Privacy Policy is provided in connection with the Personal Data Protection Act (Act 26 of 2012) of Singapore (the "PDPA"), and governed by and construed in accordance with Singapore law.

This Privacy Policy describes how we collect, use, and disclose information in Singapore. Singapore may not offer a level of privacy protection as great as that offered in other jurisdictions. In jurisdictions outside of Singapore where we are subject to different or more restrictive local laws, we may adjust our practices in those jurisdictions to comply with local laws. Otherwise, we make no representation that the practices described in this Privacy Policy are compliant with laws outside of Singapore that apply to the collection, security, use, and disclosure of information. Information that is collected or stored in jurisdictions outside of Singapore may, subject to applicable law, be disclosed or transferred to Singapore or other locations. When information is transferred to Singapore, it will be handled in accordance with the laws of the Singapore.

The term "Shopper" shall be used herein to mean those individuals that use our Store-based Clients’ webpages or other accessible platforms or portals and who may or may not provide their personal information.

How We Collect Shopper Information

Shoppers engage DataCue Products or Services when a Store-based Client installs one of our Plug-ins or other Product in association with its e-Commerce Platform. This incorporates functionality through the DataCue API Platform. Using the DataCue API, or other similarly installed Product, through a Shopper’s interaction with one of our Store-based Client’s e-commerce platforms, we collect certain information that is provided to such e-commerce platforms about Shoppers, Shoppers’ interest in product offerings, Shoppers’ historical and new orders, Shoppers’ details that are provided to the e-commerce platform, and Shoppers’ behavior and interactions while visiting the e-commerce platform. By engaging in any of the foregoing activities and/or providing consent to provide such information by accepting the terms of this Privacy Policy (as required by applicable law, and which should be incorporated into our Store-based Client’s privacy or data protection policies), Shoppers, by virtue of such engagement or consent, authorize DataCue to collect, store and use any such data that comprises personal information in accordance with this Privacy Policy.

The Types of Information We May Collect

We collect two types of information. Both types of information are required to provide the personalized experience that is offered within your store and to shoppers using DataCue enabled stores.

  1. The first type of information relates to your store. Information including but not limited to your Online Store Name, Contact Information, Customers, Product Catalog and Orders.
  2. The second type of information relates to shoppers using DataCue enabled stores. Information including but not limited to profile information such as shopping behavior within DataCue enabled stores. This information is non-personally identifiable information as it does not identify you or another person. Non-personally identifiable information includes: (i) session and usage data; (ii) log data; and (iii) aggregate information.
i. Session and Usage Data
Session and usage data is information about your use of the Website and your shoppers use of the Service, without limitation, connection and service-related data submitted to us through the use of the Website and the Service. Session and usage data includes information relating to the connection request, server communication, and data sharing, including: network measurements; quality of service; time and date of the use of the Website or the Service; and upon consent, location. We may also aggregate session and usage data as described in the aggregate information section below. Session and usage data does not include any personally identifiable information nor does it include content you or your shoppers may transmit or share through the use of the Website or Service.
ii Log Data
When you or shoppers visiting your DataCue enabled store interact with the Service or use the Website, our systems may automatically collect the unique user device number, the IP address, type of browser or operating system you or your shopper uses, and the dates and times of such use.
iii. Aggregate Information
Aggregate information is data we collect about a group or category of services or users from which individual user identities have been removed. In other words, information on how you use the Website, may be collected and combined with information about how others use the Website, but no personally identifiable information will be included in the resulting aggregate information. Aggregate information helps us understand trends in our users’ needs so that we can better consider new features or otherwise tailor the Website.

How We Keep Your Information Secure

The security of Shopper information is important to us. We implement reasonable security measures to protect the security of your information both online and offline, and we are committed to the protection of Shopper information. Only those individuals at DataCue that have an obligation to maintain confidentiality may access Shopper Personally Identifiable Information (PII).

When we handle Shopper information on the Internet we encrypt the transmission of that information using secure socket layer technology ("SSL"). DataCue has redundant and distributed systems, and other system measures, that provide for ongoing confidentiality, integrity, availability and resilience. Our systems are routinely tested or assessed for their measures to ensure the security of Shopper Data.

However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect Shopper information, we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur.

It is important for you to take steps to keep your information safe and protect against unauthorized access to any of your accounts, passwords and to your computer.

Storage and Transfer of Your Information

We may transfer, store and process Shoppers’ information, both PII and NPII, to or on computers located in the United States. Accordingly, such information may be subject to the laws of these relevant jurisdictions.

DataCue’s technical infrastructure relies on data centers and cloud service providers that are located outside Europe on the Google Cloud and Amazon Web Services platform. Amazon and Google Cloud Infrastructure are both Privacy Shield certified entities.
